Terms and conditions of sale

1. Preamble and effectiveness of the General Terms and Conditions

These general terms and conditions of sale (hereinafter “General Terms and Conditions”) apply to the remote purchase of products and services offered for sale through the Internet on the website www.geomagworld.com (hereinafter the “Website”)

The owner of the Website is Geomagworld SA, registered for tax purposes with VAT no. CHE-114539760 Via Roncaglia, no. 15, 6883 Novazzano, Switzerland.

2. Selecting and ordering products

The features and prices of the various products for sale on the Website (hereinafter “Product” or “Products”) are indicated on the page related to each product.
Customers wishing to buy the Products must fill in the order form online, following the instructions on the Website. Customers must add the Product to the “Basket” and, having read and accepted the General Terms and Conditions and the Privacy Policy, enter their delivery and billing details, select the preferred payment method and confirm the order.
By sending the order from the Website, which has the value of a contract proposal, the Customer acknowledges and declares to have read all the instructions provided during the purchase process and to fully accept these General Terms and Conditions and payment terms.
Contracts concluded between Geomagworld and Customers are understood as concluded upon acceptance of the order by Geomagworld. Customers will be informed of said acceptance through an email sent to them confirming the order and containing the order reference number, the delivery details, the list of Products ordered and their essential features, and the total price, which includes delivery costs. Upon conclusion of the contract, Geomagworld will acknowledge the purchase order and the buyer will be able to see the orders placed by logging into their account and consulting the relative section.

2.1 Errors and limitations of liability

Product information and features are available on the Website.
The visual representation of the Products on the Website, where available, usually corresponds to the photographic image that accompanies the product specification. It remains understood that the image of the Products is used for marketing purposes and cannot be perfectly representative of the Product features and qualities and may therefore differ in colour and size. Where there is a discrepancy between the image and the written product specification, the description in the latter shall prevail.
The information related to the Products sold through the Website is continuously updated. It is still not possible to guarantee the complete absence of any errors, for which Geomagworld, therefore, cannot be held liable, except in cases of gross negligence or wilful misconduct.
Geomagworld reserves the right to rectify any errors, inaccuracies or omissions, including after the order has been sent, or to change or update the information at any time without prior notice, without prejudice to the rights of the Customer pursuant to these General Terms and Conditions and the Consumer Code.
Except in cases of gross negligence or wilful misconduct, any right of the Customer to any compensation for damages or any other indemnity is excluded, as is any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by not accepting or shipping, even partially, an order.

2.2 Cases in which an order may not be accepted

An order may not be accepted in the following circumstances:

  • The information provided regarding identity, age, payment, billing or delivery are incomplete, inaccurate or fraudulent;
  • An error is detected on the Website geomagworld.com with regard to the Products ordered, for example, concerning the price or description;
  • The Products ordered are out of stock or no longer available;
  • Geomagworld SA has reason to believe that the intention of the buyer is to resell the Products.

In the event that the order is not accepted, the user will be contacted by email as soon as possible and in any case within 60 days of the order date. If the order is not accepted owing to the unavailability of the Products or to an error in the price and/or other information on the Website, any amount debited for the Products will be refunded.

3. Prices and shipping

There is no minimum order requirement to shop on the Website. Product prices are inclusive of all taxes and duties. All prices are given in euros and Swiss francs.

Deliveries in Italy and Swisserland:

The charge for deliveries throughout the Italian and Swiss territory is €10.00.
There is no delivery charge for orders worth €35.00 or more.

Deliveries in Europe (Austria, Belgium, Holland, France, Germany, Spain):

The delivery charge is €12.00.
There is no delivery charge for orders worth €39.00 or more.

Deliveries in Europe (Bulgaria, Cyprus, Croatia, Estonia, Finland, Greece, Ireland, Latvia, Lithuania, Luxembourg, Malta, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Sweden, Hungary):

The delivery charge is €20.00.
There is no delivery charge for orders worth €49.00 or more.

4. Payment methods and invoicing

4.1 Payment methods
Customers can pay for the Products and the delivery charges by Paypal or credit card on the Payrexx gateway.
The Website accepts payment with the following:

  • Visa
  • Mastercard / Maestro
  • American Express
  • PayPal

The Website does not record the Customer’s credit card number and no supplementary fee will be charged to pay by credit card.

4.2 Invoicing the orders
If the purchase is made by a professional or a company, it will be possible to request an invoice by sending an email to boutique@geomagworld.com, indicating the order number which is contained in the confirmation email and entering the invoicing details inclusive of the tax ID and/or VAT number. In this case, the invoice will be sent by email to the address indicated. The professional is responsible for correctly entering the invoicing data.

5. Transport and delivery

The Products purchased on the Website will be delivered to the address indicated by the Customer in the relative field during the purchase process.

All purchases will be delivered by express courier (hereinafter “Courier”) between Monday and Friday, except on national holidays. Geomagworld SA is not responsible for any unforeseen delays not attributable to the same.

Upon shipping the Products, the Customer will receive a confirmation email from the Courier containing a link to enable tracking of the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within the terms indicated below, counted from the day after that on which Geomagworld sends the order confirmation email to the Customer.

  • 3 working days for deliveries in Italy
  • 5 working days for deliveries in Europe (Austria, Belgium, Holland, France, Germany, Spain)
  • 5 working days for deliveries in Europe (other EU countries, EFTA countries).

Active delivery services:
TWS Express Courier srl

The service entails 2 attempts at delivery to the address indicated on placing the order. Following the second unsuccessful attempt, the package will be returned to Geomagworld SA. The Customer will need to contact Geomagworld SA in order to arrange a new delivery, which will have to be paid for separately.
Specific terms and conditions and different delivery charges apply to the different delivery options.
Upon shipping the Products, the user will receive a confirmation email from the Courier containing a link to enable tracking of the shipment.

6. Right of withdrawal

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide any explanation and without penalty, without prejudice to the cases excluding this right provided for in point IV below. To exercise said right, the Customer must send a communication to Geomagworld within 14 days of receiving the Products. Customers who wish to withdraw prior to receiving the Products may send the relative communication at any time prior to receiving them.
Instructions for sending back the Products within 14 days of their receipt:

1) Send an email to boutique@geomagworld.com
Send an email to boutique@geomagworld.com indicating the order number, which is contained in the confirmation email, and the reason for returning the Products. Wait for a reply from us.

2) Pack the products affixing the label provided by your courier
Place the Products in the original box (you may use a different box but we would encourage you to reuse insofar as is possible) and attach the new label ensuring that it covers the original.

3) Ship the products to the following address:

4) Await confirmation of the return and the refund
You will receive confirmation by email when your order has been correctly returned to our warehouse and the refund completed (2-3 working days).

The right of withdrawal is subject to the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible withdraw in relation to only part of the Product purchased.
II. In the event that the right of withdrawal is exercised, Geomagworld will refund the Customer the total price of the goods returned within 14 days of receiving the communication concerning the return, without prejudice to the right of Geomagworld to suspend payment of the refund until the goods are actually received. The refund will be paid using the same method used by the Customer, except where the latter has expressly requested a different method be used.
III. In order to guarantee that the returns made pursuant to article 8, the Products must be returned in the same box in which they were received.
IV. The returning delivery cost must pay by customer and will not be refunded by Geomagworld.
V. In addition to the cases indicated above (non-consumer customers and/or those who request an invoice), the right of withdrawal is excluded in the following cases, in accordance with art. 59 of Legislative Decree 21/2014:
– Orders for tailor-made Products or those that are clearly customised;
– Products that have been damaged due to causes other than transport.
In cases where the right of withdrawal is excluded, Geomagworld will see to the return to the Customer of the Products purchased, charging the same for the delivery costs.

7. Statutory guarantee of defective goods

In addition to the above, we offer a 2-year guarantee (or a longer period where local laws so require) covering any defects found with the Products. A Product is deemed “defective” if, on receiving the same it turns out to be damaged or if, within 2 years (or a longer period where local laws so require) of purchase, it manifests a manufacturing or material defect. Customers are reminded that Products damaged due to normal wear and tear are not considered defective.
Customers may return the defective Products within 2 years (or a longer period where local laws so require) of receipt of the same or obtain a full refund.
Customers who have received the wrong item (other than the one seen in the Geomagworld Shop) or a damaged item can return it within 60 days of the shipping date. The standard returns procedure must be followed, selecting as the reason for the return “Defective Item”.
In the event that the withdrawal period of 30 days has expired and the item is defective, Customers have 2 years from the order date to send a guarantee request. Customers are encouraged to contact our Customer Service department though the Contact Us page of the Website in order to get help returning their item/s.

8. Geomagworld’s liability in the event of a problem related to a purchase or Product

Our liability for any damages attributed to slight negligence, regardless of the legal basis, shall be limited to the following: (i) We will be liable for a maximum amount equal to the foreseeable damages typical of this type of contract for a breach of the material contract obligations; (ii) we will not be liable for very slight breaches of other applicable due diligence requirements.
The above limits on liability do not apply to statutory liability and liability for personal injuries caused through negligence. The aforementioned liability limitations also do not apply in cases where and to the extent that Geomagworld has provided a specific guarantee. In the same way, the provisions outlined also apply to our liability for minor costs.
In any case, Customers are required to adopt suitable measures to avoid and reduce any damage.
Customers are reminded that we cannot be held liable for any delay in fulfilling or failure to fulfil the obligations set out in the Terms and Conditions of sale if said delay or failure is due to circumstances beyond our reasonable control, including, for example, natural disasters, war or civil unrest, strikes, government interventions, omissions of suppliers, the communication of inaccurate information or non-payment by customers. Customers will be informed as soon as possible in the event of any of the above circumstances and we will do our best to reduce the impact of the same on our performance as far as is reasonably possible. If the interruption continues for more than 2 weeks, Customers may cancel the Order and obtain a refund.
Nothing in these Terms and Conditions of sale shall prejudice Customers’ consumer rights, such as, for example, the right of withdrawal or the right to a guarantee free of charge to cover any defects as specified in clause 7. Furthermore, nothing in these Terms and Conditions of sale shall exclude or limit any responsibility of Geomagworld that cannot be excluded or limited in accordance with the applicable law.

9. Privacy Policy

By placing the Order, you give your authorisation for the storage, processing and use of your personal data for order processing purposes. We will process your data in accordance with our Privacy Policy.

10. Use of the Website

The use of this Website is subject to the Terms and Conditions of Use of this Website.

11. Complaints

Any complaints are to be sent to Geomagworld by sending an email to boutique@geomagworld.com, or a registered letter to:

Geomagworld undertakes to respond to all the requests received within a maximum of 7 working days.

12. Applicable law and court of jurisdiction

Deliveries to an address in the EU
The purchase Contracts entered into through boutique@geomagworld.com for products delivered to an address in a Member State of the EU are subject to Italian law. Any disputes arising in connection with said Contracts shall be subject to the jurisdiction of the Court of Milan

Deliveries in Switzerland
The purchase Contracts entered into through boutique@geomagworld.com for products delivered to an address in Switzerland re subject to Swiss law. Any disputes arising in connection with said Contracts shall be subject to the jurisdiction of the Court of Mendrisio.
